La sécurité au détriment de la liberté et de la justice

Selon Sergio Carrera et Florian Geyer, du Centre d’études politiques européennes (CEPS), la stratégie politique annuelle de la Commission européenne pour 2008 prouve à nouveau que la zone européenne de la liberté, de la sécurité et de la justice est de plus en plus centrée autour de la sécurité au détriment de la liberté et de la justice.

The policy paper analyses the implications of some of the key actions envisaged by the Commission in its 2008 Policy Strategy, in the areas of Freedom, Security and Justice: ‘Fighting Organised Crime and Terrorism’ and ‘Freedom of Movement and Managing the EU’s External Border’. 

The authors notably raise some crucial questions concerning the upcoming centralised fingerprints database: just whose fingerprints is the Commission planning to store? For what purposes will the data be used, and between which authorities will the information be shared? For how long will it be stored? And what data-protection rules will control the database? 

The authors welcome the measures concerning the issue of ‘radicalisation’ but warns that the continuum considering the « lack of integration » as a cause of radicalisation may put the immigrants into a highly vulnerable situation vis-à-vis the state. 

Concerning the management of migration and the EU’s common external border policy, the intersection between migration and borders needs to be further explored and assessed from a human rights and rule-of-law perspective, the paper states. 

« The external dimension of migration needs to be strictly guided by the principles of freedom, security and justice upon which the Union is built, » the authors conclude.
